A las 8:14 am del 7 de junio de 1979, Renee Katz, de 17 años, una dedicada músico que cantaba y tocaba la flauta, estaba esperando el metro en la estación de 40 th Street y 8 th Avenue. Cuando llegó el tren E, un asaltante desconocido empujó a Katz por detrás hacia las vías. Su mano derecha fue cortada a la altura de la muñeca, pero los cirujanos pudieron volver a unirla con microcirugía.  

La policía no tenía pistas, salvo algunas descripciones vagas. Establecieron una línea telefónica directa, que incluyó el nombre de Allen Lewis entre las más de 50 llamadas grabadas. Resultó que Lewis había sido arrestado previamente por comportamiento lascivo en el tren E. A fines de julio, los detectives comenzaron a seguirlo. El 20 de agosto, Lewis confrontó a los oficiales y accedió a hablar. La policía le hizo una prueba con un detector de mentiras, con resultados mixtos. El detective John Morgan amenazó indirectamente a Lewis con una paliza durante el interrogatorio (una técnica que luego llamó "una metáfora"), y Lewis, quien afirmó que había sido golpeado con frecuencia cuando era niño, dijo que empujó a un rubio fuera de la plataforma del metro el 7 de junio. Lewis adjuntó inmediatamente esta confesión con la seguridad de que era falsa.

El caso fue a juicio a principios de 1980. Katz no pudo identificar a su agresor. Nadie colocó a Lewis directamente en la escena. El proceso duró 6 días, casi tanto como las deliberaciones, ya que el jurado se estancó 3 veces. Absolvieron a Lewis el 25 de enero de 1980. El Times teorizó que la denuncia anónima inicial que implicaba a Lewis fue hecha por Haywood Dancy, contra quien Lewis había testificado sobre un asunto no relacionado en marzo de 1979.
