Dr. X (Mario Jascalevich)

Empieza como una novela pulp: Myron Farber, reportero del New York Times , recibe una asignación de su editor. El periódico ha recibido una carta en la que se alega que un médico asesinó a 40 pacientes. Es junio de 1975. Farber rastrea las muertes hasta el Hospital Riverdell (13 muertes sospechosas antes o después de una cirugía de rutina en 1966) y hasta un cirujano jefe de ese hospital llamado Mario Jascalevich.
Jascalevich nació en Buenos Aires. Riverdell lo contrató en 1962. Poco después, los pacientes de otros cirujanos comenzaron a morir sin causa aparente. Cuando las autoridades del hospital inspeccionaron el casillero de Jascalevich, encontraron 18 botellas en su mayoría vacías de curare, un potente relajante muscular que puede matar fácilmente. Jascalevich afirmó que lo usó para experimentar con perros. Después de una investigación superficial, el fiscal del condado de Bergen retiró el caso.
Farber publicó su primera historia sobre Jascalevich, llamándolo 'Dr. X, 'ya que no se había probado la culpabilidad, en enero de 1976. Jascalevich fue acusado en mayo. Eligió a Raymond Brown, un abogado veterano que se enorgullecía de ser “duro” y “mezquino” como abogado defensor. Al frente de la acusación estaba Sybil Moses, cuatro años fuera de la facultad de derecho.
La defensa exigió todas las notas de Farber. Farber rechazó la orden y fue encarcelado por desacato. ¿Cómo se priorizarán las Enmiendas Primera y Sexta cuando las dos estén en conflicto? ¿Puede la libertad de prensa inhibir el derecho de un acusado a un juicio justo y rápido? Farber fue finalmente indultado, pero solo una vez que Jascalevich obtuvo la absolución; el jurado deliberó dos horas, poniéndose del lado del resumen de Ray Brown de que la retención de Farber sólo demostró una gran conspiración contra el médico. La licencia médica de Jascalevich fue revocada en 1980 por "negligencia grave o negligencia grave y falta de buena moral". Regresó a Argentina y murió en 1984.
