El MV Argo Merchant era un petrolero registrado en Liberia con  23 años de antiguedad,  en diciembre de 1976. Se dirigía a Salem, Massachusetts, tenía uno de los peores antecedentes en la historia marítima: 14 accidentes navales, incluidas múltiples fallas de motor, dos encallamiento y una colisión. En 1975, Bureau Veritas otorgó al barco su calificación más alta. Cuando navegó hacia Salem, tenía un giroscopio roto, cartas obsoletas y un radiogoniómetro que funcionaba mal.

La nave encalló a las 6 am del 15 de diciembre. Estaba a 24 millas náuticas de rumbo, 29 millas náuticas al sureste de la isla de Nantucket. El capitán George Papadopoulos y su tripulación, incluidos dos timonel sin experiencia, fueron evacuados con éxito, pero los fuertes vientos y el mar de tres metros impidieron reflotar el barco. Cleveland "Jomo" Davis fue a la cárcel por robar una tienda de comestibles de Virginia Beach en 1968. Se fugó antes de la sentencia y se mudó a Nueva York, donde se unió al Partido Pantera Negra. Fue enviado a la prisión de Auburn por cargos de robo, que él impugnó. Luego fue trasladado a Attica.
